1. About Triply

Triply is a platform operated by Triply Technologies Pvt. Ltd. ("Triply", "we", "us"), a company incorporated in India with its registered office at [Registered Address to be inserted], CIN [CIN to be inserted]. Triply provides a technology platform that connects private vehicle owners ("Drivers") with individuals seeking to share intercity travel ("Passengers") on a cost-sharing basis.

2. Acceptance of Terms

By accessing or using the Triply app, website, or any related service (the "Platform"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, our Community Rules, and our Cancellation Policy (collectively, the "Agreement"). If you do not agree, do not use the Platform.

3. Eligibility

To use Triply, you must:

  • Be at least 18 years of age;
  • Have legal capacity to enter into a binding contract under the Indian Contract Act, 1872;
  • Not be barred from using the Platform under the laws of India or any other applicable jurisdiction;
  • Complete the identity verification process as prescribed by Triply.

Drivers must additionally hold a valid Indian driving licence, current vehicle RC, valid motor insurance, and PUC certificate.

4. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorised use. Triply is not liable for losses arising from your failure to secure your account.

5. Nature of the Service

Triply is a technology intermediary, not a transport service provider. We do not own vehicles, employ drivers, or operate transportation. We only facilitate connections between Drivers and Passengers who wish to share intercity travel on a cost-sharing basis.

Drivers and Passengers enter into a direct arrangement with each other. Triply is not a party to that arrangement and does not assume the obligations of a carrier under the Motor Vehicles Act, 1988 or the Carriage by Road Act, 2007.

6. Cost-Sharing Rules

Important: Triply operates strictly on a cost-sharing basis. Drivers must not profit from rides. Pricing is capped at recovery of fuel, toll, and wear-and-tear costs. This is a legal requirement under Indian carpooling norms — violating it may result in your account being suspended and your vehicle being classified as an illegal taxi.

Triply calculates suggested cost-sharing amounts based on route distance, fuel prices, toll rates, and depreciation benchmarks. Drivers may adjust within a permitted range. Any attempt to charge commercial rates will result in immediate account termination and may be reported to authorities.

7. Driver Obligations

  • Maintain valid driving licence, RC, insurance, and PUC at all times;
  • Ensure the vehicle is roadworthy and meets all state-level emission and age norms;
  • Drive safely, obey all traffic laws, and not drive under the influence of alcohol or drugs;
  • Carry out posted trips in good faith; not accept bookings without intent to travel;
  • Not discriminate against any Passenger on grounds of caste, religion, gender, sexual orientation, disability, or any other legally protected characteristic;
  • Comply with all applicable laws including the Motor Vehicles Act, 1988 and GST rules where applicable.

8. Passenger Obligations

  • Provide accurate profile information;
  • Be on time at the agreed pickup point;
  • Pay the agreed cost-sharing amount through the Platform;
  • Behave respectfully toward the Driver and other Passengers;
  • Not carry prohibited items (weapons, illegal substances, hazardous materials).

9. Payments & Fees

Passengers pay the agreed amount through the Platform. Triply may charge a service fee (clearly disclosed at booking) to cover platform operations. Payments are processed by RBI-authorised payment service providers. Driver payouts are released within 24 hours of trip completion and confirmation, minus applicable service fees and GST.

10. Cancellations

Cancellations are governed by our Cancellation Policy, which forms part of these Terms.

11. Prohibited Conduct

You agree not to:

  • Use the Platform for commercial taxi operations;
  • Impersonate any person or misrepresent your identity;
  • Post false, misleading, or fraudulent listings;
  • Harass, threaten, or discriminate against any user;
  • Share contact details to circumvent Platform bookings and payments;
  • Reverse engineer, scrape, or interfere with the Platform's operation;
  • Violate any applicable law, including the IT Act, 2000 and DPDP Act, 2023.

12. Intellectual Property

All content on the Platform — including trademarks, logos, software, text, graphics — is the property of Triply Technologies Pvt. Ltd. or its licensors. You may not copy, modify, distribute, or create derivative works without prior written consent.

13. Limitation of Liability

To the maximum extent permitted by Indian law, Triply is not liable for:

  • Acts, omissions, or conduct of Drivers or Passengers;
  • Loss, damage, injury, or death arising during a trip;
  • Indirect, incidental, or consequential damages;
  • Platform downtime, data loss, or third-party service failures.

Our aggregate liability in any claim is limited to the total fees paid by you to Triply in the 3 months preceding the claim, or INR 5,000, whichever is lower. Nothing in these Terms excludes liability where such exclusion is prohibited by applicable law.

14. Indemnity

You agree to indemnify and hold harmless Triply, its directors, employees, and agents from any claim arising out of your use of the Platform, violation of these Terms, or infringement of any third-party rights.

15. Termination

We may suspend or terminate your account at any time for violation of these Terms, fraudulent conduct, or harm to other users. You may delete your account through the app settings at any time. Termination does not affect accrued rights or liabilities.

16. Disputes & Jurisdiction

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms shall be referred to arbitration under the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be [City, e.g. Mumbai], India, and the language shall be English. Subject to arbitration, the courts at [City] shall have exclusive jurisdiction.

17. Changes to Terms

We may update these Terms from time to time. Material changes will be notified through the app or email at least 30 days before taking effect. Continued use after the effective date means you accept the updated Terms.
